I wouldn't fall over myself to automatically force a 20 year old to register as a sex offender for having consensual sex with a 17 year old, either. In other words, it has to be considered on a case-by-case basis, which is surely the whole point of allowing the judge to decide.

What part of this are you interpreting to mean that if the girl was, say, 12 years old, a 22 year old wouldn't end up on the sex offenders' register? Yes, sometimes judges make shitty decisions: we all know that. But surely it's shitty to demand compulsory registration in cases where it's not deserved.
