Was the officer's intent to murder this person? Based on the story it sounds much more likely that his intent was to stop a fugitive escaping.

The article even says the charge will be upgraded to murder if the victim dies. Because you can murder someone without having attempted to do so.

This all seems very logical to me.

Im not sure how it works in the US but where Im from murder is killing another human being with malice aforethought, meaning the intention to kill or cause GBH. It would be very hard to argue that shooting at somebody doesnt constitute this, if he died.

If he didnt, it would be attempted murder here.

But this is all pointless because US laws are what matter in this case.
