But if it was only used to punish heinous criminals whose guilt was irrefutable then it sounds great for someone who murdered half their family or decapitated their lover. You really even think someone that horrible doesnt deserve death? We will never live in a world with infallible humans that always get justice right, so the hypothetical is pointless.
