Assuming the theater had lots of other patrons (who could intervene or get somebody involved), I'm not sure you could justify self-defense under almost any circumstances (well, I guess *maybe* if he'd been knocked to the ground and the guy was punching/kicking him where he might not survive until help intervened, but -- if Duck's claims are to be believed -- the guy never put hands on him). But, even if you could, he shot the wife, too. At the same time, he's 79 now. I'm not sure sending him to jail would do much good other than costing taxpayers a fortune. Just take his guns away.
