If they lose they will be tried and executed. Not meaning to defend the Nazi's, but towards the end of the war, especially after the July 1944 plot, the "I was only following orders" wasn't that much of a reach. Anyone who refused orders could be seen as a traitor and either shot, sent to a concentration camp, or a penal battalion.
