Like a police office should, Leon gave the man multiple times to cease his attack before he used lethal force. Even with a language barrier most people understand the gravity of having a gun pointed at them. But the man seemed unfazed and continued his attack. Though if Leon didn't know he was infected or anything about the plagas then I guess you could debate he could have tried to incapacitate him first.

It was only after that encounter that Leon found the "altar" with rotting skulls in it under the stairs to the second floor. Before that he had no idea there was foul play other than a man coming at him with an axe.

Then he exits the house after hearing what is obviously cars interacting. And if went up the road a ways before entering the house you can see the path blocked off by a large covered truck. Which is what forces you into the house to see what you can do about the blocked path. Only after jumping through a second story window do men again outright attack you with no provocation, thereby sealing the deal that indeed something fishy is going on.

You can't incapacitate him. You're allowed to freely shoot stuff like his feet, arms, or shoulder but he shrugs them off.
Initially Leon didn't know he was more than human. I am saying I guess people could debate as a police officer at what point does an officer move from verbal warning, to trying to incapacitate, to lethal force when he life might seemed to be threaten. All Leon was filled in on was the president's daughter was missing. He had no idea this shit was gonna go sci-fi on him.

I mean, Leon does warn him. You then have control over Leon after that and you're free to attempt to incapacitate him. The thing is, he's impossible to incapacitate because of the plagas so he might've saw that in canon too.
