If a prosecutor knows they can prove Charge A, and knows they can prove Charge B, but isn't sure they can 100% prove Charge C (but it's not impossible, given the jury/judge/etc), they will go with all three charges, A, B, and C, so that they can plead down to A and B to make it look like the defendant is getting something out of it. --- Seplito Nash, Smelling Like the Vault since 1996 Step FOUR!
