A court ruling in the mid 90s found that polling data was campaign contribution. The argument is that the information has the value that it took to obtain said information.

Since polling data is something a campaign would normally pay for, then that information has value.

Opposition research is also something a campaign would normally pay for.

That was not a court finding but an advisory opinion rendered by the Federal Election Commission. A court of law may have a different opinion, especially as it likely violates the first amendment.
