That still counts technically as a DUI since he was still impaired by drugs and was in a vehicle in a way that police determined as potentially going back on the road (impairment by alcohol works the same way), but it's the sort that likely carries a relatively light punishment if it's proven that the effects of that drug interaction were unexpected to him. Also TMZ is probably getting slammed for this since they initially reported embellishments like him allegedly weaving on the road and an officer smelling alcohol on his breath. --- Essy ...
