Apply that same logic to pictures of nude children. Doesn't matter the intent of the photographer it's still wrong and it's still cp.

Non-sexual, nude photos of children are widely (legally speaking, least in the US/wider western world) considered not to be CP. Mainly so parents who (have) take(n) photos of their children in the bath or doing an activity naked (hard to get some kids to keep their clothes on) aren't charged with production/distribution of CP.

Now, obviously, online it's a different story and many sites will absolutely not allow even non-sexual/medically necessary nude photos of kids to be hosted, to completely dodge the remotest possibility of attracting pedophiles testing the limits or potentially be found liable for hosting something that breaches into the realm of CP.
