keeping someone in a user contest plainly does not constitute harassment as defined by 'Continual harassing behavior directed towards a certain individual or group by another individual or group with the intent of creating an intimidating, offensive, or hostile environment on the Service.' even without getting into what constitutes continual harassing behavior, the intent part isn't there.
i don't think anyone would argue that talking about a user is harassment. by the same token, it's fine to discuss how much you value a user relative to other users. uoty is just that with numbers attached.
dunno what the precedent is, though. the text of the tou has never stopped the moderation staff before!
