I delete the files and I proceed to purchase it. You could argue about the ethics of my actions, but I think that they are perfectly reasonable in both a utilitarian and Kantian sense.
Why do you mention Kant and Mill specifically? Those aren't the only two types of ethical systems out there. In fact, I'm not even sure this does mesh with Kantian ethics, as it would demand that pirating files you "wouldn't pay for otherwise" be made universalizable.
