A 22-year-old is facing murder charges after he shot and killed a man who was allegedly attempting to rob his family home in Milton, Ont., his lawyer says.
The incident happened on Feb. 19 at about 5 a.m. at a residence on Gibson Crescent, which is near Ontario Street South and Louis St. Laurent Avenue
According to Halton Regional Police Service, a group of suspects intent on committing a robbery approached the house in question.
Once inside, they were reportedly confronted by an occupant and a number of gunshots were then fired within the home. A man was pronounced dead at the scene.
Ali Mian, who lives in the home with his single mother, is now facing second-degree murder charges, his lawyer says.
In a statement provided to CP24, criminal lawyer Jag Virk said his client "shot at an intruder that broke into his home and attacked his mother."
"He is a registered firearm owner and used his gun legally against an armed intruder," Virk said. "He shouldn't be charged with murder for protecting his mother from someone that broke into his home."
Virk said Mians intention was "not to kill the intruder, he only shot at him once."
Halton police said the investigation ongoing and that detectives are currently looking for information pertaining to three outstanding suspects who they said fled the scene in a light-coloured Dodge Charger with a sunroof and black wheels.
Romario Clarke, 20, was also arrested when officers when arrived at the scene. He has been charged with one count of break and enter and unauthorized possession of a firearm.
On Sunday, investigators said the shooting was isolated to the home and appears to be targeted. They also advised residents that they should expect to see a continued police presence in the area, as the investigation is underway.

On a Tuesday afternoon in the summer of August 2022, federal workplace safety inspectors responded to a police report that a 17-year-old worker had suffered fatal injuries after being pulled into a woodchipper at a work site near Allentown.A U.S. Department of Labor Occupational Safety and Health Administration investigation determined that the teens employer a Lehigh Valley tree service company owned and operated by Adam Atiyeh could have prevented the incident by following required federal safety standards.
OSHA learned that the young worker was partially pulled into a woodchipper as he fed entangled material into the machine on Aug. 9, 2022, at a Schnecksville site and later died from his injuries. Investigators were told the company had allowed three minor-aged workers to operate the woodchipper, a hazardous occupation forbidden by federal child labor laws.
Agency investigators found the employer, which operates as both Adams Tree Service and Adams Tree Removal and Trimming, failed to:
  • Provide and make sure employees used personal protective equipment including safety shoes, safety glasses, gloves and hard hats.
  • Train workers to safely operate a woodchipper.
  • Have personnel at the work site with first aid training.
  • Maintain portable fire extinguishers at the work site.
The agency issued the company and Atiyeh citations for 10 serious safety violations and proposed total penalties of $124,987.
The dangers of tree-trimming and operating a woodchipper are obvious and widely known, and yet this employer exposed a teenager to deadly risks. Now his family, friends and co-workers are left to mourn, said OSHA Area Office Director Jean Kulp in Allentown. The willingness of this company and its owner Adam Atiyeh to expose workers without proper safety equipment and training to such hazardous work is hard to understand. Employing minors to do this work is unconscionable.
OSHA has referred the alleged child labor violations to the departments Wage and Hour Division for further investigation.
Based in Schnecksville, Atiyeh and his company provide services for property owners in Bethlehem, Schnecksville and throughout Lehigh County.
The employer has 15 business days from receipt of citation and penalties to comply, request an informal conference with OSHAs area director, or contest the findings before the independent Occupational Safety and Health Review Commission.

As police in Denver investigate, there are still a lot of questions surrounding what led up to the fatal shooting of a 12-year-old boy in a stolen car.
Denver Police say they got a report Sunday about a car stolen from the Central Park neighborhood. The cars owner said he was using an app to track it and eventually saw it stop all the way at an intersection in the Sun Valley neighborhood, about 15 minutes away.
According to police, the owner went to the cars location and approached the stolen vehicle before he was involved in an exchange of gunfire.
After the exhange, police say 12-year-old Elias Armstrong drove the car a few blocks away, where he was found injured from a gunshot. Police believe other people in the stolen car ran away.
Armstrong was taken to the hospital but didnt make it.
Police say the cars owner talked to officers about the incident. He had not been arrested as of Wednesday, as the investigation continues.
Police have not determined who fired first or what led up to the exchange of gunfire. All of it is under investigation and will be factors in the current determination regarding arrest. Its also unclear if the cars owner informed police before taking action.
Ultimately, it is the district attorneys office who will decide if charges should be filed.
Some residents of the Sun Valley neighborhood feel the fact a 12-year-old boy lost his life in this incident is heartbreaking.
Denver City Councilwoman Jamie Torres shared the same sentiment in a statement.
Im heartbroken that this ended in the death of a 12-year-old, she said. I know auto theft is a growing issue, not just in Denver but everywhere, and its infuriating to be victimized like that. But I discourage any resident to taking a vigilante approach.
A police spokesperson said in a statement that they recommend against owners trying to recover their own stolen vehicles, saying car thieves could be armed. Instead, victims are encouraged to provide any details to police, including the location if the car can be tracked.

Laval police spokesperson Erika Landry identified the driver as a 51-year-old employee, but did not release his name. Laval Mayor Stphane Boyer said the driver has worked for Societe de transport de Laval for about 10 years and has no incidents of note in his file.

A man who lives near the day care said he rushed to the scene of the crash and that he and three parents managed to subdue the driver, who he said stepped out of the bus, removed all his clothing and started screaming.
The first thing he did was take off all his clothes after opening the bus door. .... He was just yelling; there were no words coming out of his mouth, said Hamdi Benchaabane.
Benchaabane said he and the others had to strike the driver to get him under control, before police cuffed the man. The driver, he said, was in a different world.

Authorities in Quebec said two children have died and six others were taken to area hospitals with injuries after a city bus drove into a daycare center in a Montreal suburb Wednesday morning. During a briefing Wednesday, a spokesperson for Laval Police said the driver of the bus, a 51-year-old man who is a city transport employee, was arrested and charged with homicide and reckless driving.
He will be meeting the investigators but as of now we do not know the motive of the crime, said Erika Landry, a spokesperson for the police in Laval.
We have six kids that have been transported into different hospitals in Montreal and Laval, but unfortunately we have two other kids that died as a result of the accident, Landry said.

A man armed with an AR-15 style rifle and 13 ammunition magazines opened fire in an Omaha, Nebraska, Target store Tuesday before he was killed by a responding officer, police said.
The shooting just before noon sent customers running out of the store or hiding in fitting rooms, but no one else appears to have been shot.
Omaha Police Chief Todd Schmaderer said 911 calls were made shortly before noon local time about an active-shooter inside the store, which prompted a heavy police response from local, state and federal authorities.
"The first arriving officers went into the building, confronted the suspect and shot him dead," Schmaderer said during a news conference.
Police said the man, who has not been identified, fired inside the store and was fatally shot by an Omaha police officer.
"He had an AR-15 rifle with him and plenty of ammunition," Schmaderer said.
Omaha police officers and a Nebraska State Trooper entered the Target and encountered the gunman with the rifle, police said.
Officers issued numerous loud verbal commands ordering the suspect to drop the rifle, the police department said in a statement Tuesday evening. An Omaha officer fired their handgun at the gunman, killing him, according to police.
At least 29 people called 911, police said. Some customers ran outside when gunshots were heard.
Jasmine Gascar told NBC affiliate WOWT of Omaha that she was in a fitting room and hid there. Others rushed in to hide as well. She reported hearing between 10 to 15 shots.
"I was sure I was going to die. I was sure," Gascar told the station. She texted people and told them that she loved them.
Investigators conducted sweeps of the store but did not find any victims, and as of Tuesday night no one had arrived at local hospitals on their own, police said.
Mayor Jean Stothert said that police saved lives by their response.
Target said in a statement that all employees and customers safely evacuated from the store, and the company thanked police. Target will provide counseling to workers, it said.
Police said the gunman will be identified once next of kin is notified. The investigation is ongoing, the department said.

A former Republican county elections commissioner in upstate New York pleaded guilty Wednesday to applying for absentee ballots in the names of other registered voters.
Jason Schofield, who is from Troy, resigned last month from the Rensselaer County Board of Elections. He admitted that in 2021 he unlawfully used the names and birthdates of voters in connection with 12 absentee ballot applications he submitted electronically to the New York State Voter Absentee Ballot Application Request Portal, according to federal prosecutors.
Schofield, 43, admitted he falsely certified that he was the voter requesting each of the absentee ballots.
When Schofield was originally arraigned in September, his attorney said Schofield maintained he was innocent of the charges in the 12-count indictment.
Schofield is scheduled to be sentenced on May 12. He faces up to five years in prison, a fine of up to $250,000 and supervised released of up to three years for each count.

Police in Richmond Heights are investigating after a womans car was stolen and her son shot at the suspects.
According to the Richmond Heights Police Department, the incident took place Monday morning in the area of I-64 and Big Bend Boulevard. A womans BMW was stolen in Sunset Hills.
Police said the womans son followed the suspects to Big Bend Boulevard and I-64 and rammed his car into the stolen BMW. He then got out and fired shots at the suspects, striking one of them in the leg.
The injured suspect was taken to a hospital with non-life-threatening injuries. Most of the other suspects were taken into custody after fleeing into a nearby neighborhood. One remains at large.
Investigators said two schools in the area were placed on lockdown but have now resumed normal operations.
No other information has been released at this time.

Its entirely possible that if they were wearing a helmet they might have survived, but again, we cant say for sure. It certainly would have improved their odds, said Eric Teoh, who has researched motorcycle safety at the Insurance Institute for Highway Safety.

A Russian warplane crashed Monday into a residential area in a Russian city on the Sea of Azov after suffering engine failure, leaving at least 13 people dead, three of whom died when they jumped from upper floors of a nine-story apartment building to escape a massive blaze.
A Su-34 bomber came down in the port city of Yeysk after one of its engines caught fire during takeoff for a training mission, the Russian Defense Ministry said. It said both crew members bailed out safely, but the plane crashed into a residential area, causing a fire as tons of fuel exploded on impact.
After hours of combing through the charred debris of the building, authorities said 13 residents, including three children, were found dead. Another 19 were hospitalized with injuries.
Vice governor of the region, Anna Menkova, said three of the four victims died when they jumped from the upper floors of the building in a desperate attempt to escape the flames, according to the RIA-Novosti news agency.
The authorities reserved emergency rooms at local hospitals and scrambled medical aircraft. Over 500 residents were evacuated and provided with temporary accommodations.
The Kremlin said Russian President Vladimir Putin was informed about the crash and dispatched the ministers of health and emergencies along with the local governor to the site. Yeysk, a city of 90,000, is home to a big Russian air base.
Surveillance cam videos posted on Russian messaging app channels showed a plane exploding in a giant fireball. Other videos showed an apartment building engulfed by flames and loud bangs from the apparent detonation of the warplane's weapons.
The Su-34 is a supersonic twin-engine bomber equipped with sophisticated sensors and weapons that has been a key strike component of the Russian air force. The aircraft has seen wide use during the war in Syria and the fighting in Ukraine.
Monday's accident marked the 10th reported non-combat crash of a Russian warplane since Moscow sent its troops into Ukraine on Feb. 24. Military experts have noted that as the number of Russian military flights increased sharply during the fighting, so did the crashes.
