TopicHoratio Sanz accuser seeks to add more 'SNL' alums to lawsuit

More than a year after a Pennsylvania woman filed a lawsuit against comedian Horatio Sanz, SNL Studios and NBCUniversal, she's filed a proposed amended complaint seeking to add Tracy Morgan, Jimmy Fallon, and "Saturday Night Live" creator Lorne Michaels as defendants, arguing they enabled Sanz's alleged misconduct.
In 2021, the woman said Sanz, a former "SNL" cast member began grooming her when she was around 14 and sexually assaulted her when she was 17 years old, according to court documents.
At the time of the initial suit, the woman, who is identified only as Jane Doe, alleged that Sanz sexually abused her by "kissing her, groping her breasts, groping her buttocks, and digitally penetrating her genitals forcibly and without Plaintiff's consent" at and after "SNL" parties, CNN previously reported.
Sanz has denied the allegations.
In the proposed amended complaint filed Tuesday, the woman says Fallon was "aware of Sanz's online grooming efforts as he was of his in-person conduct." The filings also claim NBC, Morgan, Fallon and Michaels "enabled Sanz's crimes of sexual assault and battery" by "providing the physical space whereby Sanz assaulted Doe and by repeatedly ignoring and even encouraging Doe's underage presence at SNL after-parties and after-after-parties."
The new proposed complaint comes as a result of New York City's recently amended Gender Motivated Violence Act (GMVA). The GMVA includes a one year "lookback window," allowing accusers to sue their alleged abusers and those accused of enabling that conduct, effective next March.
According to the act, violation "means a crime of violence committed because of gender or on the basis of gender, and due, at least in part, to an animus based on the victim's gender."
In a brief in support of her proposed amendment, she explains, "While Doe's claims are currently barred by the statute of limitations, on March 1, 2023 (and until March 1, 2024), Plaintiff's claims will not be time-barred, and she will be entitled to bring her GMVA claims against all proposed defendants as a result of the look-back window in the amended GMVA." She asks the court to grant her request to amend her complaint to add the GMVA claims now in the interest of judicial economy.
An NBC spokesperson said to CNN in an email, "Regardless of Jane Doe's changing narratives, NBC intends to renew its motion to dismiss."
NBCUniversal filed a motion to dismiss in April, arguing that "the Complaint fails to set forth facts showing that in 2002 NBCU was aware of Sanz's alleged predatory behavior or of any propensity he had for sexual assault," and noting that "Plaintiff does not allege that she, or anyone else, informed NBCU nineteen years ago of the facts she alleges in her Complaint today."
NBCU also argued that she did not adequately allege a "causal connection between NBCU's alleged breach of duty and Sanz's alleged sexual assault during a party hosted by a co-worker at an off-premises location."
Sanz filed an answer in April to the initial complaint, denying the allegations. His filing also alleges numerous defenses to Doe's claims, including that her claims are not timely filed and that, to the extent he engaged in any of the alleged conduct, Jane Doe consented to the alleged actions.
CNN has reached out to representatives for "SNL", Fallon, Morgan, Michaels and Sanz for comment.
In the new proposed complaint, Jane Doe says she texted Sanz in 2019 and "he claimed said he 'felt terrible' about" what he'd done.
"However, he avoided taking full responsibility, saying, '...I let us get closer and closer. I was a weak man.'" the suit said.
The suit asks for monetary relief for legal fees as well as compensatory and punitive damages.

TopicAhmaud Arbery killer gets life sentence for federal hate crime conviction

Travis McMichael, one of the three White men convicted in the killing of Ahmaud Arbery, was sentenced Monday to life in prison plus 10 years after his federal convictions this year on interference with rights -- a hate crime -- along with attempted kidnapping and weapon use charges.
His father Gregory McMichael and their neighbor William "Roddie" Bryan are due to be sentenced later Monday at the same Georgia courthouse on convictions of the same federal charges. All three already are serving life sentences for their convictions in state court on a series of charges related to the killing of the 25-year-old Black man, including felony murder.
Travis McMichael, his father and Bryan were found guilty of the federal charges in February, with the jury accepting prosecutors' argument the defendants acted out of racial animus toward Arbery. Travis McMichael, who fatally shot Arbery, was also found guilty of using and carrying a Remington shotgun while his father, Gregory was found guilty of using and carrying a .357 Magnum revolver.
Travis McMichael's life sentence, along with 20 years on the attempted kidnapping charge, is to be served concurrently with his state sentence, US District Court Judge Lisa Godbey Wood ruled Monday, with the additional 10 years on the weapons charge to be served consecutively. The judge ruled Travis McMichael did not have the funds to pay a fine.
Arbery's killing, months before the police killing of George Floyd in Minneapolis, were in some ways harbingers of the nationwide protests that erupted that summer as demonstrators decried how people of color sometimes are treated by law enforcement.
To make their case, federal prosecutors focused on how each defendant had spoken about Black people in public and in private, using inflammatory, derogatory and racist language.
Prosecutors and Arbery's family had said he was out for a jog -- a common pastime for the former high school football player -- on February 23, 2020, when the defendants chased and killed him in their neighborhood outside Brunswick, Georgia.
Defense attorneys argued the McMichaels pursued Arbery in a pickup truck through neighborhood streets to stop him for police, believing he matched the description of someone captured in footage recorded at a home under construction. Prosecutors acknowledged Arbery had entered the home in the past, but he never took anything.
The defense also argued Travis McMichael shot Arbery in self-defense as they wrestled over McMichael's shotgun. Bryan joined the pursuit in his own truck after seeing the McMichaels follow Arbery in their pickup as he ran; Bryan recorded video of the shooting.
Two prosecutors initially instructed Glynn County police not to make arrests, and the defendants weren't arrested for more than two months -- and only after Bryan's video of the killing surfaced, sparking the nationwide outcry.

TopicBlack Couple Wins Lawsuit After Police Allegedly Profiled In Their Own Store

A California city has agreed to pay $150,000 to Yema Khalif and Hawi Awash, a Black couple who said they were racially profiled when police asked to them prove they own their clothing boutique. The coupled, who filed a lawsuit last year, said they were working late at the store when a Tiburon police officer entered the building in August and asked them to identify themselves.
Khalif and Awash argued with officers, saying they didnt have to prove that they have the right to be in their own downtown boutique, Yema.
The officer should have knocked, introduced himself, and explained he was patrolling Main Street, Awash said, according to KTVU. But instead it was more like, Who are you? And prove yourself.'
A neighboring business owner eventually resolved the conflict, confirming that the couple own the store. The police department later faced backlash when video of the incident went viral. A police sergeant resigned amid the backlash.
Khalif and Awash filed a $2 million suit for alleged emotional distress and potential loss of revenue, as well as punitive damages. In addition to rewarding $150,000 to the couple, the settlement now calls for reforms, including a new citizens police advisory panel.
As Blavity previously reported, Awash and Khalif received threats in 2020 as the nation was awaiting the results of the presidential race. The perpetrator went to Instagram to reveal plans about destroying Yema, the citys only Black-owned store at the time. The post included a photo of the store.
If Biden wins me and the boys gonna go raid yemma, the person wrote. 4:00 on Election Day show up.
Awash and Khalif, two immigrants from Ethiopia and Kenya, received support from the community after their encounter with police.
Weve gotten support and love and people speaking up to say this is not right, this is wrong, Awash said. Working while black is not a crime, and many people are standing with us, and thats the conversation we need to have, lets change the perspective.

TopicRacist High School prom proposal

Each year high school students find creative ways to ask someone to prom. But a recent promposal involving Central High School students in Kane County wasn't creative at all. Some students are calling it racist.
A photo of the promposal that's being shared on social media shows two teens holding a sign that reads, "If I was Black, I'd be picking cotton, but I'm white, so I'm picking you. Prom?"
"I think the student should face some type of repercussion, whether it is suspending or expelling them, for sure not letting them go to prom," said senior Kayla Haynes.
Not everyone was offended by the sign. Haynes said some students see it as a joke.
"I was not surprised but I was disappointed more of just seeing the kids I grew up with, seeing a different side of them," she said.
There have been reports of similar promposals over the last few years at high schools across the country.
School and district officials are aware of this incident.
"The derogatory, racist remarks in the post do not reflect Central 301's values or our standards of appropriate and acceptable student conduct," said Superintendent Todd E. Stirn in a statement. "Actions that go against our values of inclusion and respect have no place in our schools or our school-sponsored activities."
Only 2% of students at Central High School are Black, according to the Illinois Report Card. The school is 62% white, 19% Hispanic and 13% Asian.
Sophomore Ashli Bonds said racism has been an ongoing issue at the school and it needs to finally be addressed.
"There's too many situations that happened where kids think that it is OK now and they know that they will get away with it," she said.
School officials said they can't discuss any disciplinary action being taken against the student who organized the promposal.
Prom is set for this Friday.

TopicCouple charged with manslaughter over death of morbidly obese daughter

Two parents have been charged with manslaughter after allegedly allowing their daughter to become morbidly obese.
In what is believed to be the first case of its kind, the parents of Kaylea Titford, 16, appeared in court on Tuesday after being charged with gross negligence manslaughter and causing or allowing the death of a child or vulnerable person.
The disabled teenage girl was found dead at her home in Newtown, Powys, Wales, in October 2020.
It is alleged that between March 24 and Oct 11, 2020, Kaylea's father Alun Titford, 44, and mother Sarah Lloyd-Jones, 39, of Colwyn, Newtown, failed to ensure that her dietary needs were met, leading to morbid obesity.
Nor did they ensure that she got enough exercise, was in a hygienic condition, had a safe and hygienic environment, that her physical health was maintained or that reasonable medical help was sought, the charge claims.
The pair appeared before Welshpool Magistrates' Court on Tuesday and stood together in the dock wearing face masks. They spoke only to confirm their names, ages and address, but did not enter any pleas.
Helen Tench, prosecuting, asked both defendants to remain on conditional bail and not to have contact with anyone under the age of 18. They will appear before Mold Crown Court on April 14.
The case is believed to be the first time parents have been charged with such an offence.
In 2014, two parents were arrested on suspicion of cruelty and neglect of their obese child. A 49-year-old man and a 44-year-old woman, from King's Lynn, Norfolk, were questioned by officers over the child's care and released on bail.
At the time of the separate case, Norfolk Police said intervention at this level was "very rare" and only occurred where other attempts to protect the child had been unsuccessful.
According to reports, the 11-year-old boy in the case was 5ft 1in tall and 15 stone, with a body mass index (BMI) of 41.8.
"When dealing with sensitive issues such as obesity and neglect of children, officers from the force's Child Abuse Investigation Unit work closely with partners, significantly with both health care and social services, to ensure any response to address them are proportionate and necessary," Norfolk Police said in 2014.
However, the case against the parents in Norfolk was dropped and they were not prosecuted.

TopicPolice chief fired over minority-first practices in hiring and promotions
UnlikedMonkey

The city of Fort Lauderdale has fired its police chief Larry Scirotto, who has been in office for less than a year, following allegations of discriminatory practices for promotions.
Scirotto was sworn-in as police chief in mid-August, and the city had hired a law firm by November to investigate complaints of discrimination before he was fired on Thursday, according to a copy of the law firm's report obtained by CNN.
Scirotto told CNN Saturday the report that triggered his termination from the department was "vague on the facts," and was largely based on hearsay.
The investigation concluded that during his time as police chief, Scirotto implemented an approach to hiring and promotion that was unfairly focused on minority candidates.
The report said Scirotto once pointed to a conference room wall displaying photos of the department's command staff and stated, "that wall is too white," and "I'm gonna change that."
Scirotto told CNN he promoted 15 people from August to November, and of that group, six were ethnic or gender minorities selected for promotions based on their merit.
"None of them were promoted because they were in a protected class," he said. "They were promoted because they were the best candidates."
Scirotto said he has obtained legal counsel and is planning on filing a wrongful termination lawsuit against the city.
"If promoting diversity is the hill I'm going to die on, I will sleep well tonight," he said. "I won't allow them to tarnish my reputation. I won't allow them to tarnish the work that I've done in the 24 years I've been in this profession."
In one example in the report, Scirotto is alleged to have overlooked a White man with 20 years tenure with the department, and instead narrowed the choice between two men of color, and asked, "which one is blacker."
When asked about his approach to promotions, Scirotto told investigators he was going to "consider diversity at every opportunity," and he had to be "intentional" in his decision-making process.
Scirotto denied asking which candidate was "blacker" when deciding on the promotion, but admitted to making comments about the wall being "too white," because he felt it was not reflective of the community, according to the report.
"He said the context of the comment is built around 'how do I convince the community that we are an inclusive and diverse organization if this wall is so white?'" the report said.
In total, 21 witnesses, including the chief, gave a consistent narrative to investigators about Scirotto's hiring and promotion practices, the report reads. The investigation also concluded "almost every witness was dissatisfied," with Scirotto's approach to promotions, and "most believed that Chief Scirotto made clear his intention to promote based on race, gender or sexual orientation."
"Some believed it was about time changes were made, but stated if promotions were based on things such as race it would even hurt or undermine the people promoted," the report said.
The city ultimately decided to cut ties with Scirotto, who did not have a contract with the city and will not be receiving a severance, city spokesperson Stephen Gollan told CNN.
"Following a thorough and extensive investigation of employee complaints at the Fort Lauderdale Police Department, City Manager Chris Lagerbloom, has determined that it is in the City's best interest to separate employment with Larry Scirotto," the city said in a statement dated March 3.
The city's police department is now under the leadership of Acting Chief Luis Alvarez, the city said, and the selection process for a new chief is underway.
Speaking to CNN affiliate WFOR, Scirotto said the investigation was "built on hearsay," and lacked testimony, transcript and audio.
Scirotto also provided WFOR with what he said was context for his comments about the wall being "too white."
"The bottom row had several white males and one white female. And we're talking in conversation as it relates to our community and the expectation of a diverse and inclusive organization. And how do I purport we have that when the entire bottom row are white men?" Scirotto told WFOR.

TopicTeacher suspended for showing class picture of Bin Laden as the Prophet Mohammed

A Church of England school has suspended a teacher for showing a picture of Osama bin Laden as the Prophet Mohammed during a religious education lesson.
All Saints Academy, a mixed secondary school in Dunstable, Bedfordshire, issued a profuse apology over what it described as totally inappropriate images used in a presentation for a Year 10 lesson last week.
A concerned pupil was said to have raised concerns with the school about the presentation slide, which showed a picture of the al-Qaeda terrorist next to a caption saying it was the Prophet Mohammed and, in the line below, Last prophet in Islam".
The school has faced a furious backlash from Britains Islamic community after what was said to be a picture of the slide was obtained by 5Pillars, a Muslim news website, on Friday.
Within hours, the school posted a brief statement on social media saying: We are fully aware of a totally inappropriate use of resources that was used by a teacher during an RS lesson today.
As soon as we became aware of its existence, the offensive image was removed from all devices and an immediate investigation was launched.
The school added that it apologised unreservedly for the offence caused by the image, but criticism on social media continued to intensify over the weekend.
The wrongful use of Bin Ladens image was compounded by the fact depictions of the Prophet Mohammad are, in themselves, considered to be deeply offensive to Muslims.
Dilly Hussain, the deputy editor of the 5Pillars website, described it as disgraceful and unacceptable.
By Sunday, the school had decided to post a more detailed statement on social media which acknowledged how grievously it had inflamed religious sensitivities.
It said: Not only was it offensive to attempt to portray an image of the Prophet (Mohammed), but the image that was used was that of Osama bin Laden, a terrorist leader, which further added to the deep insult.
The statement disclosed that the member of staff involved in the lesson was immediately suspended, pending a detailed and swift investigation.
It said it would be against the academys disciplinary procedures to identify the teacher involved.
The school also pledged to commission an independently led review of the circumstances surrounding the case to determine how this individual came to act in such an inappropriate and upsetting way.
The statement continued: "Having now established very useful links with members of the Muslim community in Luton, we would hope to work together to gain a better understanding of religious and cultural matters that impact on all our lives and will help us to be better educators.
All Saints Academy describes itself as a Church of England school which is governed in accordance to a "Christian ethos".
Its website says: Our faith is central to everything that we do.
