1: The legend never referred to Goku's transformation. Broly was the legendary super sayian of that generation. Vegeta outright states the legend says the "legendary once in a 1000 years super sayian" can't control himself when powered up, Goku just got really pissed. Well, more pissed than he was when he transformed. Broly meanwhile was totally unable to control himself when powered up, fighting literally everyone around him. And if we consider Super canon (it is), then how being a Super Sayian effects Broly is canon as well. See the lead up to the tournament between the Universes.
2: Toryiama isn't actually that good of a writer and just made shit up on the fly
