Justice Barrett brings up a good point. The special counsel's brief brings up the fact that Trump engaged in private acts sufficient to charge even if the court rules that some of his acts were official acts. Trump's lawyer concedes that private acts can be charged. Barrett went through some of the alleged conduct in the indictment and Trump's lawyer agreed that they were private acts.
This isn't going well for Trump. Which shouldn't be a surprise, given the absurdity of this appeal, but... The fact that we're even here at SCOTUS arguing about this bullshit is nuts, and makes me uneasy.
