Former President Trump is railing against the amount of times his legal team can veto a potential juror choice for his hush money trial, which kicked off Monday.

I thought STRIKES were supposed to be unlimited when we were picking our jury? I was then told we only had 10, not nearly enough when we were purposely given the 2nd Worst Venue in the Country. Dont worry, we have the First Worst also, as the Witch Hunt continues! ELECTION INTERFERENCE! Trump wrote on his Truth Social platform Wednesday morning.
Another interesting thing about the strike they are using, it's the flop system. Both sides don't know who is coming next. So while you can strike a juror now, you don't know who you will be getting next. It's quite interesting actually.

Also, both sides get the same amount.

You also can't strike a juror based on them being in a protected class on that alone.

But that's ground enough to call for recusal to Trump.

Of course, Trump doesn't actually know how recusal or bias actually work let alone jury selection but if he thinks it's biased you can bet all his happy trained seals will be saying it.

I am looking forward to seeing if Trump strokes out just from having his credibility impeached like this in a setting where he can't just walk away or silence the critics with an outburst.

And the best part is that even if a Trumpist on the jury prevents a verdict, that just results in a new trial where, among other things, he gets to have his credibility impeached again, just like this.

No, it's not. Mistrials can be tried again. For one or both side(s) that can be detrimental to their case just as much as it could help them.

Well, maybe can be retried, it is about as settled as Roe v Wade was. The basing for hung juries and mistrials to be retried was on a ruling that decided that jeopardy is not attached until the verdict is decided. But more recent than that the Supreme Court has ruled jeopardy attaching when the jury is seated.

So should there be a hung jury or mistrial, fully expect a case before the SC on DJT claiming double jeopardy.

He's constitutionally allowed to. He can waive the right, and he did, but they still had to let him sit if he wanted to.

Then why was he requesting it as if he didn't? And what about cases where the jury is kept anonymous from the defendant, which is something that happened in one of his civil cases.

A hung jury leading to a mistrial does not lead to double jeopardy because that result brings the trial to a standstill with no resolution. Double Jeopardy applies when there's a final resolution to the case. Their actual angle from that point would be to go after the judge or the prosecutor for procedural violations.

I'm pretty sure I heard someone saying yesterday it's been done before when necessary. Trump is definitely one of those cases because as Jack Smith successfully proved when Trump talks negatively about people it spurns domestic terrorists into a frenzy and brings on thousands of death threats, leading to people having to get protection such as the court employees in pretty much all of his cases now.

As another said, I'm pretty sure his lawyer substitutes for him personally in this, because they were the ones interviewing the potential jurors and Trump requested the ability to be able to personally stand there so he can glare at them in an effort to intimidate them, which he has a very demonstrable history of doing to witnesses and jurors. I don't see why he'd need to request that privilege if it was automatically given to him.

As it stands today, but you didn't read my whole post, but now I have time to source it so hopefully you can understand it better.

The foundation for retrial is from 1824, US vs Perez, which ruled based not on the Constitution but rather English Common Law that jeopardy does not attach until the verdict is rendered.

However, in Downum v US (1963), Crist v Bretz (1978), and Martinez v Illinois (2014), the Supreme Court has consistently held that the federal rule for trial by jury is that jeopardy attaches when a trial jury is sworn.

Should any of Donald's jury trials end in a mistrial or hung jury you can guarantee that he will take any attempts to re-try him to the SC and there is a very good chance he wins given which way they lean.

Is this strictly in the cases of hung juries or mistrials? Or can Cannon wait until the jury is set then dismiss charges against Trump, then Trump argue any further attempts to prosecute him for mishandling documents is double jeopardy?

While this is correct, the prevailing ruling has been that a hung jury does not terminate jeopardy, and thus the original jeopardy is being sustained into the retrial. Thus, no double jeopardy.

It's amazing in the worst possible connotation the extent to which this guy will go to test the legal system's willingness to hold him accountable. I think he's unrivaled in this by the way he's doing it, only way to go up (or down) here is to be like Gotti and personally threaten/bribe witnesses and jurors.

He's already been doing that for months by saying there's no way he could get a fair prosecution/jury in Manhattan and sought a venue change as part of that push.

This is just more personal because the jury is real and being selected.

This is why I'm not hopeful that Trump will ever see the inside of a prison cell even if he's found guilty in any of these criminal trials. He can just do shit that would easily land you or I in jail and nothing happens except maybe a lecture from the judge that he promptly ignores.
