The law might be on the bully's side unfortunately. I've heard of similar stories involving coworkers and unless you can reasonably argue that the beverage was for your own consumption then you can get in trouble for setting traps like this, even if the other person had to steal to get caught.

Taking a swig of something gross and not knowing what you just drank could trigger a very adverse reaction, sort of like a reverse placebo effect
