Let's say I have VPN enabled on my phone which is hosting a hotspot connection. Then I connect my laptop to said hotspot without enabling the VPN on that device.

Am I still protected from the network provider in that scenario?

Yep, with a VPN the only thing your ISP will be able to see is the transfer load. They can probably guess what you're doing based on that, but they can't and won't come down on you for it. They won't bother your landlord because they won't have a case to go off of.
