Not in my book. It's lying, but the soda would probably get spilled from lazy people massively overfilling their cups.

Restaurant or fast food?

I don't self serve my drinks in restaurants.

it's stealing.

If they give me a water cup I don't fill it with soda.

If they give me a soda cup even though I asked for a water, I fill it with soda

If it's a get waited on restaurant I tell the waitress that I didn't order it and if they say keep it free, fine.

If it's a place where I get my own drink I use basic morals & decency and get water if I order water.
