I'm baffled that the suit actually went anywhere. While, yes, the pornographic content (such as it was) did in fact exist on the disc, and it's not incorrect to say that the content was therefore distributed to anyone that bought the game, it was impossible to actually access it without jumping through so many hoops that nobody would ever see it by accident, all of which amounted to orders of magnitude more effort than it would take to just find regular porn. Like Rockstar's entire defense should have just been to hand the prosecutor a computer with the unmodified game and tell them to demonstrate to the court how easy it is to get to the lewds. Even if they could have done it, the number of deliberate steps that required specific technical knowledge well outside of simply playing the game (especially on platforms other than PC) would have demonstrated beyond a shadow of a doubt that nobody was going to see the content unless they really wanted to.
At best, Rockstar could maybe share some blame for the fact that people googling GTA:SA could end up stumbling across the video of the mod that unlocked the content, but even that's like blaming Blizzard for Overwatch R34. You can't really control what the community does with your IP.
