The Department of Justice is preparing to ask a Washington, DC grand jury to indict former president Donald Trump for violating the Espionage Act and for obstruction of justice as soon as Thursday, adding further weight to the legal baggage facing Mr Trump as he campaigns for his partys nomination in next years presidential election.

The Independent has learned that prosecutors are ready to ask grand jurors to approve an indictment against Mr Trump for violating a portion of the US criminal code known as Section 793, which prohibits gathering, transmitting or losing any information respecting the national defence.

The use of Section 793, which does not make reference to classified information, is understood to be a strategic decision by prosecutors that has been made to short-circuit Mr Trumps ability to claim that he used his authority as president to declassify documents he removed from the White House and kept at his Palm Beach, Florida property long after his term expired on 20 January 2021.

That section of US criminal law is written in a way that could encompass Mr Trumps conduct even if he was authorised to possess the information as president because it states that anyone who lawfully having possession of, access to, control over, or being entrusted with any document ...relating to the national defence, and willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted or attempts to communicate, deliver, transmit or cause to be communicated, delivered or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it can be punished by as many as ten years in prison.

It is understood that prosecutors intend to ask grand jurors to vote on the indictment on Thursday, but that vote could be delayed as much as a week until the next meeting of the grand jury to allow for a complete presentation of evidence, or to allow investigators to gather more evidence for presentation of necessary.

As much as I'd love to see him making his dumb pouty face in an orange jumpsuit I'll believe it when I see it. I'm also skeptical we'll get a judge with the spine to impact his quality of life if he is convicted.

No, they don't have to tiptoe around it. It's just an indictment that makes it impossible for his lawyers to even waste time with that argument because it's moot. One thing that people like him like to do is make you waste time proving things that they know to be false as false.

"Judge with a spine" is an oxymoron so yeah, fully expecting nothing more than a slap on the wrist.

Pick any of the following reasons:

"It would be too divisive to prosecute him when what our country needs now is unity."

"None of those classified documents actually contained sensitive information anyway."

"The election is coming up and we should really let the good American people have their say in the matter, not have some court decide it for them."

"Surely a fine that's less than half the amount of money he made from selling those classified secrets is punishment enough."

They have to be super super super careful here because even a minor violation of 4th or 5th amendment rights will get the charges dismissed with prejudice. This entire trial is just Trump's lawyers waiting for the DoJ to make a tiny little procedural mistake to hang them with.

Maybe I'm getting my terminology mixed up here but I always understood defection to be specifically leaving to join the other side. Instead he was a prisoner when we found him.

Sounds like a totally normal and functional legal system and not a sham at all.

Regular people have their 4th amendment rights violated every day and still get charged.

I know. I'm just saying it's fucking absurd that we'll ram drug possession cases through court despite illegally obtained evidence but we must be absolutely meticulous, precise, and utterly perfect to so much as bring a man like Trump, who openly and proudly commit crimes, to trial.

It's infuriating. I can't take anyone involved in our court system seriously. Judges and prosecutors have such an elevated sense of self-importance despite being nearly useless in any serious matters.
