I don't think you know how the Supreme Court works if you think rescheduling a drug to a lesser criminal rank is something they would even take up!

Or that they have much of a say in what debts the federal government can't forgive.

One of the biggest changes in the court makeup is how they see the role of federal agencies and the level of deference they have from congress.

It's why Trump lost like 90% of his court cases when it came to deregulation. It's like if they wanted to decriminalize Marijuana and some Southern State Attorney General threw a fit, the SC would likely rule in their favor. The SC has very much been about curbing executive branch power and you can bet your ass a 6-3 conservative majority would be all over a Socialist president.

This is an example of what I'm talking about. Basically federal agencies and bureaucracies being forced to follow the exact letter of the laws written by congress with no wiggle room. Meaning if congress doesn't pass a law about the where, when, why, and what of how to achieve a goal within said law, they'd have almost no way of enacting those measures.

You do realize that in the Controlled Substances Act that in the very law that created the DEA, that Marijuana is listed as a schedule 1 narcotic, and that if the SC doesn't believe in deference of a federal agency, the only way to remove it from a schedule 1 listing is by a new law from congress, right?

I kinda assume that when Biden finds himself with a split government for the final two years of his presidency, there will probably be a lot more executive action. How much will actually be good policy? Couldn't tell you. But he's been shown to be rather easily influenced even by the more progressive members of the party and they've apparently done things like wipe out $10 billion in student debt.

And I'm always of the mindset that I want to focus 99.9% of my rage towards the biggest pieces of garbage, first. Its hard for me to be super mad at Biden when he's working with the most do-nothing group of GOP to ever exist.

Rock is right here, the complete loss of SCOTUS has basically crippled progressive legislation for at least a generation, probably two.

Debt forgiveness would immediately face a wave of challenges and even if I beleive Biden has the authority I also sure as hell don't trust that a partisan court upholds it, especially with how friendly it has been to corporations.

this is kinda what the case law of the take care clause is about. hell, scotus (at the time 4-4 because of garland's seat being held up and so not precedent) started to raise the signal that it might strike down DAPA because of it. Trump rescinding it mooted the case so we don't know how they ultimately would have ruled but seeing that they split 4-4 with a much friendlier court composition...

I will say though that I'm not sure they would overturn rescheduling a drug. Like, I see where Rock is coming from on this but I'm also not entirely sure who even would have standing to bring the suit. Congress? Would they even bother?

But SCOTUS would 100% kill any meaningful executive orders if Biden (or hypothetically Sanders) tried to use them. Would it be completely hypocritical of them given their behavior and attitude towards EOs under Trump? Absolutely. Have we already seen them pull this exact shit? Absolutely. Just look at the travel ban saga or remain in Mexico and how they treated it under Trump versus all the barriers and orders thrown up to force Biden to continue enforcing parts of it and preventing the administration from just ending them.

And they'll still be right. There was a once in a generation opportunity in 2016 for Bernie to win. That was the one time in decades where moderates/centrists didn't have a majority. We could either embrace Bernie Sanders or Donald Trump. Hillary supporters made sure it was Donald Trump and now we are set on that path.

Did the Supreme Court ever rule on DACA? That would be the archetypal case for the limits of prosecutorial discretion - whether the President as chief law enforcement officer can order the DOJ not to enforce the law as to a whole class of people. Sorry my memory has gotten pretty poor to where I can't remember if there was a ruling on this or not.

Ok, I looked up the Supreme Court's decision on DACA. They punted on the core issue and found that Trump's rescission of it violated the Administrative Procedure Act. Still, that's arguably precedent for DACA itself being legal. It doesn't make a lot of sense to talk about rescinding an unconstitutional policy in an illegal way, right?

Honestly these kinds of articles are probably a big reason Susan Collins won. People do not like people from the rest of the country telling them how they should vote for their own representatives in Congress.
