Before reading it, however, I will say complaints are just bare allegations. I've seen all sorts of crazy shit alleged that is almost never true, at worst usually a misunderstanding. It's rare I get a client actually harboring overt discriminatory or otherwise oppressive workplaces.

Hi, good job twisting my words.

This DFEH complaint is 2 years into an investigation, a different situation from most single plaintiff claims against your standard employers. I probably spoke too soon by giving my insight on employment defense generally before reading anything, so I guess I deserve any drive-by virtue signaling directed my way.

I don't think anybody actually said that outside of Mac, but I'm pretty sure Mac doesn't know how to not be an asshole, so that's a big who cares.

I think the takeaway is just that it probably would have been wise to read it before coming in with "These are usually people making shit up or at worst a misunderstanding" since that post kinda looked bad given how egregious this case is.

Skimmed a bunch of the docket, will look in its entirety (I used to be do paralegal work in criminal, not civil) more in depth at work, but one thing to play devil's advocate: "playing video games on company time" is kind of weak when said video games are what your company produces.

That sexual misconduct, though, appears heavily substantial, and is unforgivable.

To elaborate, and I will give my job as an example

Wage difference can be a factor of many things and automatically assuming "she earned less because she is female" is wrong
As a System Administrator that got promoted from a Helpdesk support agent I can tell you that wage difference be be caused from those reasons as well - among others I do not list
1.My initial wage I requested was extermely low (like, minimum wage low)
2.I started off as a outsource worker
3.I didn't ask for raises
4.Inflation cause new workers to earn/ask for more money over the years
Combine all those and I am still getting paid less than a Helpdesk Support Agent in the same organization

As for "the male got promoted instead of me"
Helpdesk support agents are being gauged by -
1.The amount of tickets they close
2.How people are satisfied by their service

Now you know me I am not the nicest person around so yeah..I didn't get enough good feedbacks. But I am with much more technology knowledge than the other helpdesk agents and I got promoted
I also didn't have a high amount of closed tickets because I was assigned for "harder" problems they couldn't fix

So imagine this scenario-
A female helpdesk support agent complains that I got promoted instead of her
She states that she has more positive feedbacks than I do and also close a lot more tickets and the only reason I got promoted instead of her is because of gender discrimination. She doesn't state the fact that she doesn't have a good technical knowledge.
Now you paint this picture, add fuel to the (justified) fire that there actually is a gender discrimination in the company, and suddenly nobody ever cares about checking the facts and just assume that this is really caused by a gender discrimination

yeah this is bad. i actually have a friend who works at blizzard and used to work with a girl who was part of their legal team for a couple years. wonder what their thoughts are.

but i will maintain my original post that this is an unusual employment case compared to individuals bringing their own claims, even through the aid of a plaintiff's attorney.

part of me wonders what the story is behind kaplan's sudden departure.
