I think Nintendo's entirely in their right on this one. The tourney runners are profiting off of this and using emulation/mods which have the potential to paint the game in an unfavorable light should bugs/whatever happen.

I mean if the tourney organizers didn't outright advertise "YO WE USIN' MODS" and weren't profiting off of it, this wouldn't be a problem. They treated it like a legitimate tournament despite using mods and sold tickets/whatever the hell they now have to refund, so it's pretty fair for Nintendo to "wait, no?"

Nintendo is "within their legal rights" but this is a dumb move on their part. Nintendo wouldn't be where they are right now if not for a thriving online community. You have to find a way to overlook this while still protecting your trademark in order to create goodwill with fans and to keep the community growing.

This is so anti consumer though. Damn we really gotta protect the pockets of Nintendo and stop a whole community from being able to exist in the process because Nintendo deems them too small to profit off.

Which is fair, but where I tend to side with Nintendo is the fact that they apparently contacted them and asked them not to run the online Melee portion, which would've left the Ultimate tourney still intact. They refused, so Nintendo shut the whole thing down. Silly? Sure, a little bit. But there are so many steps in the "This could have been avoided" category that they ignored/refused that it's very hard for me to feel like Nintendo overstepped.

"anti-consumer" is thrown around a lot on the internet. A business protecting its intellectual property at the risk of inconveniencing an objectively small subset of its consumerbase is not anti-consumer. It's business.

People mention this all the time but it's straight up not true for copyright, it only matters for trademark protection, which this doesn't violate at all. Also even for trademark protection it generally only works like this if you attempt to come after a specific person after previously not taking action against that same specific person

Most Melee players also play Ultimate. They're different enough, and Melee still plays well enough that it's sticking around.

This news made me want to try this game. Melee feels strange after all this time. There are no controller settings in Melee, so no tap jump off, c stick to tilt, or remapping buttons in-game, although you can certainly do that last part on PC. Not sure how much using a PS controller is an issue.

Ok I'll give this a shot and argue with a lawyer over something I know little about. It's the B8 way.

The argument is usually made that if nintendo doesn't push back on emulation/modding/etc then nintendo can lose the right to push back in the future against all of these types of categories. As far as I can tell, these are basically copyright rules copy pasted 1/1 into categories that aren't actually copyright. No cooperation has yet to lose the power to (here's where I'll trip up and use the technical wrong legal term so please put the right one in when you read this) pursue action on emulation based on inaction. You could look at this as them playing it safe, which is exactly what they're doing. But there are lots of other things that could make nintendo lose copyright control over their products that nintendo doesn't guard as heavily and treat as militantly. (well nintendo actually does, as super smash bros on it's own is basically a showcase of "hey we still own literally all of this" but other major video game companies don't go this far, and I imagine without smash, nintendo wouldn't bother either.) Nintendo is basically on the front of "what should we do with media that we own but we want to resell but also we can't resell because we don't have the technology yet" so they get to basically make the rules deciding what they can and can't do legally. They're not at the whim of the law, they're making the law. They're the viacom or disney of video games, so saying "that's just the way the law works! Shrug!" is dishonest. The law works whatever way they want it to work because at the end of the day it's going to be an incredibly wealthy company going to sue some neckbeard who owns 34 copies of pokemon but copy number 25 is a rom.
