I expect anything and worse from the GOP.

Which is why they should never get in power again.

They've proven definitively over the course of the last four decades that their aim is the destruction of American ideals.

They don't get to "bounce back" simply because they're the "other side".

It's actually a pro-GOP argument pretended to be a shitty democrat one.

Letting things get absurd is good tho. The more justices there are on the supreme court the less effect an individual judge has.

Also, are we really pretending that whenever the SCOTUS switches to democratic favour, whenever that's gonna be, the GOP won't just pack the court as soon as they have whichever government chamber is required to do so?

Packing the court is the only option left at this point. Kavanaugh should be impeached and removed, but the 2/3rds vote needed for it is completely impossible.

Here's the thing: if Hillary was in power and put in two justices, court packing would be the first thing on the GOP agenda. And they would do so the moment the Dems were unable to stop them.

They aren't going to do it.

When the democrats controlled the senate they changed the rules to make it easier for Obama to put in judicial nominees by killing the filibuster.

Now, thanks to that rule, Trump has filled the courts with dozens of right leaning judges. What would stop the next Republican president from packing the court in response 4 or 8 years down the road?

It also polls very poorly because it stinks of an authoritarian power grab.

you know theyll bounce back

why do we know this

the incentive to pack the court is that currently the court has five justices who want to let state legislatures upend their own voting systems and ignore the will of the voters

packing it would mean preventing this and thereby preventing republican 'bounce back' since when people can vote, they lose

it polls better than the appointment of ACB actually

thanks to that rule and republicans' refusal to accept any obama nominee once they recovered the senate no matter what. trump got all these appointments because there were so many vacancies, and there were vacancies because republicans made sure there were vacancies.

which is also what they were doing when the filibuster applied

so it seems more like republicans executed a strategy and would've changed the rules themselves the moment they got power

since they changed the rules for SCOTUS the moment they got power

all democrats would be doing now is following the republican example and changing the rules again

the alternative is to lose

what stops republicans from doing it is people voting.

if we don't pack the courts, republican state governments will be able to ignore the result of their own elections, a position supported by 5/9 of the current court

I really think this whole "don't stoop to their level" mentality is going to be a thing of the past soon. It's pretty idiotic when their level is clearly helping them gain and hold power and influence, and you're doing basically nothing to stop it.

I mean yeah but this is under the assumption that they win power like this again in the future. Which is possible. They wont hesitate to pack the court regardless of whether or not dems do it now as long as its politically advantageous.

Those people acting as if there's any political decorum at this point are being disgustingly disingenuous and are only holding one side to a standard to benefit their own side's gain.

more than possible, if we don't pack the court at this point it is probable that they will seize power against the will of voters.

They will someday control The Senate again if they lose it, and they will seek revenge.

Each party will seek revenge, playing increasingly polarized constituencies against each other in their stupid little game until they lose control and disaster ensues.

I agree they will bounce back and it will be a total shitshow.

The only thing the Dems can do is stop Republicans from getting the majority again in their current form. Supposedly all they would have to do to do this is basically ban gerrymandering and greatly increase voting access. They could also make DC and Puerto Rico States but that would be more controversial.

Actually, no party in US history will have survived as many rebranding efforts as the GOP will have to in effort to rally after Trump. The GOP's survival is not guaranteed, particularly after boomers start to die en masse.

1. Biden wins, but SCOTUS keeps Scoting

2. Dems don't pack SCOTUS as show of good will (or at advice of GOP cabinet Biden selected)

3. Biden admin uses first two years to cool off

4. McConnell retakes the senate in midterms

5. Stephen Breyer (Clinton appointee) dies towards end of Biden's term, leaving another vacancy for SCOTUS

6. They deny his pick again

7. GOP wins presidency, installs a 7-2 majority scotus of 30-50 year olds

Pretty much. Democrats don't have the balls to do anything. They always cave and it's a shame we have to depend on them to stop the Republicans when they're just so weak.
