Yes, he can do if it the Senate goes along with it. The Senate proposes adjourning until after the election, the House says no, the President adjudicates between them. And adjourns them both until after the election.

Although I don't know what purpose adjourning Congress would serve, unless to demonstrate that he can exercise one of the primary powers of a British King - proroguing or dissolving Parliament.

Oh god, I hadn't seen that news and just reading the quotes in this topic without the tweets I thought it'd be a discussion about Trump ordering Congress back in session as a PR play since both chambers are like "we out until may. peace."

But holy shit that's some high tier authoritarianism right there. Not the part of that clause I thought we'd be talking about because it's just so blatantly and explicitly unconstitutional. ...Not that that's out of character with this administration, but still.

He's definitely pushing it. He's probably right in the end when it comes to an emergency situation but I'm thinking it's like all his other high level powers: used as a threat. Emergencies do give the executive a shitton more power but he generally likes the "I could do this but I won't+ approach.

But I just want Congress to have their vacations cut because it's nonsensical that they got to fuck off in this kind of situation. They've been horrible between the lack of a recorded vote, the vacation, and the amount of pork in their bills. If they got paid in their time off it should've been cut and they should be shamed to high hell.

well no the defense would be that it's not something he can do constitutionally. he'd argue a mix of that power with emergency powers, though how the specifics fall, i have no idea.

it wouldn't even be a court case though since by the time it runs through the courts, they're back in DC. so it's pretty useless as an actual threat in the end, which makes this usage weirder but... hey, if it gets them back to work, good.

SCOTUS already ruled unanimously against Obama when he tried to appoint an NLRB Director saying it was a recess appointment because House Republicans refused to agree to adjourn the House to constitute a constitutionally acceptable recess for such appointments but in all practical senses Congress was in recess. And note this was done at a time when the Senate was Democratic! It was House Republicans who were able to prevent it from being a recess because neither chamber in Congress can adjourn for more than three days without consent of the other so the Senate had to hold these to uphold that and while the Obama administration argued that those weren't real sessions... again SCOTUS was 9-0 in saying "nope."

This is 100% super unconstitutional lmfao. No "emergency powerzzzzzzz" argument exists here.

So the Roman Senate would give a reason when they named a dictator. Usually it was a vague "for the matter to be done" which in practice meant to lead the country at war, but they also appointed dictators for purposes such as holding elections, leading religious ceremonies, and rewriting the constitution. Trump can be dictator for the reopening of the country.
