Why is anyone even entertaining notions like this, anymore? Does anyone think that once power fantasies like this leave college campuses and Instagram posts, they will be accepted by the rest of society as a whole? Hell freakin' no. The masses--actual people in the actual world would laugh at the idea that your sexual preferences might be discriminatory. It's absolute lunacy.

I think for myself, just like some random guy on the internet I agree with 100%.

OR, you know, the brain is a weird, weird thing and what you "are" outside of what your biological make up is (male, female, damaged or otherwise in error genetics leading to a third option) can all be down to incorrect brain chemistry.

The brain is who you are. Your body informs that by providing the lens through which your experiences are filtered, but if that body doesn't align with what the brain is expecting, does it not make more sense to change the body than to tell the brain that it isn't itself?

But since doctors can make a mint, they unethically encourage these people to mutilate themselves.

Oh? What other treatment options have proven effective enough to be considered a more ethical recommendation? Since you seem to know more than these doctors and all.

What if you're a prostitute but refuse to have prostitute with a black person?

Huh, as dumb as this sounds, this actually makes sense to me. Mostly because it's just talking about business action and not any of this garbage.

You could argue that prostitutes create art, and you can't economically force an artist to create something that they don't want to create. With all of the personal creativity related stuff.
Buuut, you can't claim it's a painting, or video, or sculpture, or anything else similar to that. It's not under any of traditional legal definition of art, from my quick googling and skimming of a pdf.
I don't think that would hold water.

Hilariously, you could claim it as "fine art" under The New York Act, as you can't have more than 500 copies of it, but you still have to define it as art, so we're back to the "it's not art" problem.

You could, theoretically, also trademark a sex move/position. You have originality (including substantial originality), figuring out how to separate different trademarks would be difficult, but not impossible as well. The usefulness clause can basically be ignored, because hue hue sex.

the thing that people don't understand, and what always makes these topics difficult:

DISCRIMINATION IS NOT ALWAYS BAD OR INAPPOPRIATE

yes, not having sex with someone because of their race (or ANY categorical reason) is discrimination.

and that is ok, people are allowed to discriminate.

Because that's the approach that's most likely to yield a better prognosis.

When people have bad ideas we also try to change their minds.

What we change is indeed based on pragmatism, it's not validation of wrong think.

Hmmm, have you seen modern society?

I'm completely pro-trans and everything, but that argument just doesn't work.
