Yes they did. It wasnt a dare where they said this could hurt you do it!...They use the nitrogen for effect and led her to believe it was a safe shot to take. Clearly they fucked up and their fuck up led to this.

I mean at least to me I think taking the shot on fire seems more likely. Like I might have tried if I could have done it without burning my upper lip. Kind of the same thought as putting out a lighter with your finger. Doesn't burn because it goes out right away.

I'm certainly not gonna take something that's steaming off especially after a warning.

I feel bad for the girl and think this sounds ridiculous and shouldn't be legal but given that it's legal and the warning is given I can't see this as the bars fault.

Im assuming it's safe after the vapors are gone and that's what she was supposed to wait for. That said upon rereading i think I might have changed my mind. Doesn't sound like a real warning was given. My opinion would depend on exactly what was said.

After the McDonald's case, every fast food has "Caution! Hot" all around their cups. Does this now count as good enough warning if you burn yourself from now on? What needs to be made clear is if the bartender gave a good enough warning about how long to wait (until the vapors dissipate, perhaps?) before drinking, or failed to do so.

Every normal functioning persons knows that hot drinks(and fire) are hot, and thus can cause injury. But many people don't know what liquid nitrogen is, nor how cold it is. After all most people don't encounter it outside laboratories, or gastropubs.

Even if she was told to wait certain time, i would still be on her side. People don't go to bars and stay sober while spending quality time there. They shouldn't serve dangerous drinks to people who are drunk, drinks that could even kill them.

Maybe someone thinks the worst thing that could happen is that they feel gassy as bartender said, or the drink would just taste different.

Maybe if they told the customer that you might fucking DIE drinking this, and make them sign some papers, then i would somewhat accept that.
