The filibuster was never a rule to begin with, just a mutually accepted gentleman's agreement about Senate procedure. There's also a ton of ways around it, an Democrats aren't exactly one to talk since they used budget reconciliation to weasel the ACA through the Senate's filibuster.
To be fair, I can't remember the last time either party legitimately filibustered a Supreme Court nominee, so Democrats were kinda pushing their luck a bit by going that direction. --- Physician [Internal Medicine] ... Copied to Clipboard!

By legitimately filibuster, I mean successfully and permanently blocking a nominee. The Democrats actually failed their filibuster of Alito. Mostly because nobody has ever seriously attempted a literal filibuster of a nominee on the Senate floor in decades. The Senate has a constitutional obligation to confirm (or not confirm) a nominee, which has generally been interpreted as the Senate actually has to vote on a nominee, and a filibuster essentially violates that rule.
