Edit: I'm assuming you mean you scare someone and they jump up in fear and die somehow. Obviously, if you were, say, encouraging them to commit suicide, it would probably be a harder charge.

Assuming you are meaning you have them initiate an action that you do not know will have the consequence of their death, I do not see how you could label it as murder since you are not intentionally killing them by this method.

If, however, you are suggesting you are not murdering them because you never know if gravity will decide to work or not, then you would have a pretty good idea they would be killed and thus would be an indirect murder.

Legally, it would probably be argued that you had no intention or reasonable idea that the action you took would lead to their death and it would be more an accident rather than full blown murder.

Now, if the person you 'jumped' was 70 and had a pacemaker, then perhaps the story would be different...

Ticket for disturbing the peace.

If you scared someone and they died of heart attack I'd say you'd have a good argument against committing murder. But if they gasped and took a few steps back, say down a flight of stairs or off a ledge somewhere...then you're looking at hard time.

Either way, you're looking at lawsuit.
