The contract is made in a legal system where policies are created against a certain social context that the customer is violating, assuming the server did a good job

Because the customer is wrong.

Not as wrong as the employer - they should be run out of town on a rail and banished, and their property seized - but still wrong.

Because theyre not allowed to opt out and demand minimum wage. Most people dont choose a restaurant as a first choice, so when you finally go in for the interview, youre pretty much going to cave to whatever policies theyve got.
