The phrase "seperation of church and state" does not appear anywhere in the Constitution. It has no legal matter. The first Amendment also stated that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof, meaning that your hypothetical point has been rendered invalid for 231 years.
