U.S. District Judge Fernando Rodriguez, Jr., a Trump appointee, ruled Trump had improperly invoked the law which gives the president the power to quickly expel nationals of invading countries to target alleged members of a Venezuelan gang, Tren de Aragua.

The Alien Enemies Act applies only when the country is facing an armed, organized attack, Rodriguez ruled. Trumps claims about Tren de Araguas activities in the United States fall short of that bar, the judge added.

The act had been invoked just three times in U.S. history before Trump issued a proclamation last month deploying it against Tren de Aragua.

The Proclamation exceeds the scope of the statute and, as a result, is unlawful, Rodriguez concluded. [Administration officials] do not possess the lawful authority under the AEA, and based on the Proclamation, to detain Venezuelan aliens, transfer them within the United States, or remove them from the country.

Obama made barely any judicial appointments his last 2 years because of McConnell so that both dropped his number and boosted Trump's who was inaugerated the first time with a record number of judicial vacancies. Obama also wasn't against moving a Bush appointed judge up a level when there was a vacancy. Democrats did not have their eye on the courts like we should have. Biden I think made a fair number of appointments but we're playing catch up.

I wish that judge well, in their new residence in El Salvador.
Good. It's uplifting to see even conservative judges recognize this for how unlawful it is.

Any kind of push back is important here. The more people telling him no, the better.

Republicans famously don't look at anything besides the "R" next to the name as to whether or not they like the person in question.

Biden was actually pretty on point with judge appointments.
The commercial says that Church isn't for perfect people, I guess that's why I'm an atheist.

As long as they don't step out of line. This judge's saving grace is he'll be out of the spotlight once the Supreme Court picks up this case. No idea how they're going to rule.

In Trump is going to be in a unique position where he has a lot of first-term judges that have been on the bench for a while now compared to a consecutive term.

Oh yeah, Donnie will question whether there is a conflict of interest with this liberal appointed judge because he name sounds Hispanic and obviously HE would have never appointed such a DEI judge to a position like that.

The administration asked the Supreme Court to strip temporary legal protections from 350,000 Venezuelans, potentially exposing them to being deported.
The Justice Department asked the high court to put on hold a ruling from a federal judge in San Francisco that kept in place Temporary Protected Status for the Venezuelans that would have otherwise expired last month.
A federal appeals court had earlier rejected the administrations request.
The Trump administration has moved aggressively to withdraw various protections that have allowed immigrants to remain in the country, including ending TPS for a total of 600,000 Venezuelans and 500,000 Haitians.
TPS is granted in 18-month increments to people already in the U.S. whose countries are deemed unsafe for return due to natural disaster or civil strife.

they try to get the cases in front of judges they or their side appointed because they would be more likely to rule in their favor

they won't put it in front of a dem appointed judge because the chances of ruling in their favor would always be near 0
