The law firm of Reichman Jorgensen Lehman & Feldberg (RJLF) has announced a landmark victory in its trademark case against comics publishers Marvel and DC Comics. They have obtained an order from the U.S. Patent and Trademark Office cancelling Marvel and DC Comics' joint trademark for the word "Super Hero" and thus allowing their clients, S.J. Richold and Superbabies Limited, to freely use the term.This was granted after Marvel and DC failed to respond to court requests.

That was never trademarked. And if it was it was never strongly enforced. Super hero gets used to describe a great many things.
If you want something done right, do it yourself.

This. But trademarks and patents for broad concepts like this need to be rejected, anyway. There's protecting an IP and then there's just being a trademark troll/patent pest. These types of applications should be thrown out immediately and those submitting them should be laughed at.

That's good. It was always puzzling to me how they were able to stake a claim to such a vague descriptive.

It's probably no shock, given how widespread the use has been. It's nice to see it formalized, though.

My guess is they realized they stop defending the trademark a long time ago and "super hero" has become a very generic term they knew they wouldn't be able to keep.

It was trademarked, but it didn't prevent it from being used in dialogue or whatever, as that's not how trademark works. It means it couldn't be used in the title of comics books and possibly other media (you have to specify the specific media/markets that the trademark applies to, and I don't know exactly what their trademark was for).

They filed together to share the trademark, which should have been a clue to whoever approved it that it had become a generic term and shouldn't have been approved in the first place.

Trademarks are about usage for things that identify the product like titles and logos, not for things within the product like dialogue.
