A woman in Germany has been given a harsher sentence than a convicted rapist after she was found guilty of defaming him.

Maja R, a 20-year-old from Hamburg, called him a disgraceful rapist pig and a disgusting freak, defamatory under German law.

He was one of nine attackers who gang-raped a 15-year-old girl in a Hamburg park in 2020, in a case that shocked the city.

Maja R was sentenced to a weekend in jail for her verbal attacks. The rapist was given a suspended sentence and served no prison time due to his age.

The sentence has sparked anger over what critics see as the flaws in Germanys judicial system, with disproportionate punishment for defamation.

Eh, not necessarily, sadly. Only recently has Germany really started updating/expanding their rape laws. They were EXTREMELY lax before, and they're still adapting.

Is it really that important of a detail, though? Regardless of age, rape should be punished worse, period. Whether that means the defamation laws need updated, rape laws need updated, or the ruling was bunk to begin with, whatever, but... We shouldn't really be going "Oh, it's okay they didn't get any real punishment for rape because of their age."

EDIT: Yeah, per the post above, the judge literally even lamented, presumably, that they couldn't be punished further, since they didn't show any regret.

...They didn't, though? Atleast, not if you think about it for two seconds. The entire point of this topic is, clearly, to point out that the rapist got no actual punishment. They just brought up the defamation case to show the absolute absurdity of it all.

This is one of the hubris of developed countries going too far. Being lenient on minors is something more developed countries tend to do. Being harsher on hurtful rhetoric is also something developed countries have been cracking harder on. Combine the extremes of both and you get stuff like this.

What does this story have to do with being lenient on minors? A minor was gangraped in part by a guy ruled too old to serve prison time. The message here is that he's not too old to rape but apparently too old to incarcerate and that's a shit message.

prison sentences should generally be much less than what america does on average, but things like rape and murder should definitely still be punished harshly since those offenders arent suitable to be in normal society

While there are situations where someone is so old they're shown mercy by the court, I admit it's on me for not properly researching that and I jumped to a conclusion. It makes more sense that they were given leniency due to being a minor.
