A shutdown would not block trade, travel or entry by immigrants presenting themselves lawfully for asylum at ports of entry. But it would block migrants from applying for asylum if they crossed the border between ports of entry during the shutdown.

WASHINGTON President Joe Biden is expected to sign an executive action Tuesday that would temporarily shut down the southern border when daily migrant crossings between legal ports of entry exceed 2,500, with the border reopening when the number falls below 1,500, according to three people familiar with the discussions.
The White House has conveyed this threshold to lawmakers, two of the sources said, but stressed some details were still being finalized before Tuesdays anticipated rollout.
Daily encounters at the U.S.-Mexico border are currently averaging more than 4,000, according to Department of Homeland Security officials, which suggests a shutdown could go into effect immediately, though administration officials are bracing for legal challenges.

Details of the executive order were reported exclusively by NBC News on May 23. A critical consideration was working with the administration of Mexican President Andrs Manuel Lpez Obrador to get its cooperation on some key provisions, according to multiple officials familiar with the negotiations. On Sunday, Claudia Sheinbaum, whose candidacy was supported by Lpez Obrador, won election to succeed him as president.
The executive action is expected to rely on a presidential authority in the U.S. Code known as Section 212 (f), which would let the president unilaterally suspend the entry of specific groups of migrants whenever the number of attempted border crossings grows too high.

A shutdown would not block trade, travel or entry by immigrants presenting themselves lawfully for asylum at ports of entry. But it would block migrants from applying for asylum if they crossed the border between ports of entry during the shutdown.

According to one of the sources, the administration studied what was done under Trump administration and tried to avoid legal pitfalls, carving out exceptions for unaccompanied children and victims of trafficking.
DHS is also expected to redesignate Temporary Protected Status (TPS) for Haiti, which would enable certain Haitian nationals who are in the U.S. to remain until conditions improve in Haiti, three of the sources said.
The country has been largely in control of armed gangs since March, and many lawmakers on Capitol Hill have urged the Biden administration to extend TPS to Haitians and to halt deportations.
In recent days, the White House has reached out to mayors of border cities to attend the signing of the executive order, according to a source familiar with the matter.

Border politics have been a hot topic for months, with an effort by Senate Democrats in May to advance a bipartisan border security bill hitting a wall.
In February, senators released details of a bipartisan agreement that would have imposed tougher immigration and asylum laws and allowed Biden to shut down the border when it becomes overwhelmed, the president said in January in urging lawmakers to pass the bill.
But just days later, Republican senators killed the bill their own party had negotiated with Democrats.
Border security appears to be a weak spot for Biden, according to polling. Former President Donald Trump has a 30-point edge with registered voters on the question of which candidate would handle immigration and border security better, including a 23-point edge among Latino voters, according to a late March CNBC national poll.
If elected, Trump has vowed to launch the biggest domestic deportation operation in his second term. During his administration, Trump made it harder for foreign-born workers to enter the U.S., with visa denials rising by over 20% in both fiscal year 2018 and 2019 and refugee admissions decreasing.
There were 179,725 encounters along the southern border in April, a slight decrease from recent months, according to U.S. Customs and Border Protection. Over 1.5 million encounters have been recorded this fiscal year to date, meaning fiscal year 2024 has so far outpaced fiscal years 2023, 2022 and 2021 in encounters, according to the data.
One of the sources said the administration is bracing for attempted crossings to rise again this summer, so the decision was made to act now.

I dont have an issue with immigration. I do have an issue with uncontrolled immigration.

Im from the UK so I dont know the nuances of how this will work in the US but if its the same as the UK both main parties will play lip service to immigration while year on year the numbers increase.

Cheap labour and a low birth rate in the UK make it too attractive for the economy.

In the flip side with growing climate change the flow of people wanting to get into western nations is only going to increase. What are we going to do when tens of millions of people start moving? We cant let them all in. Whata the answer? I honestly have no idea.

Well just to reiterate I have no issues with immigration per se.

Im not politician so my answers here are going to be clunky and Im open to being persuaded that my points dont stand up to scrutiny. My issue is as much to do with the way we handle the claims as much as it is to do with migrants overall.

Gamefaqs has a tendency to refresh mid post on my phone so Ill post one point per post to reduce the chances of me losing a load of text.

1) We have more migrants coming over than we can process. The figure stands at around 163k as per official government figures awaiting an initial decision. While steps have been taken to reduce this backlog Id want to see more movement on this and until that happens a reduction in migrants coming in.

As per the link below over 100k have been waiting for longer than six months for an initial decision.

Over 50k of these are being housed in hotels at the tax payers expense. As of the date of the below article this was a 10% increase in the previous year. Its not necessarily the number in hotels but the trend in the numbers going up. As per my point above Id like to see these number decrease and claims handled quicker and until such a time this happens and the back log reduced the number of migrants should be controlled better.

2) Migrants coming over generally are prepared to work for less money. This undercuts wages and while its great for the economy and businesses its bad for your average Joe. As someone who I suppose might be called a socialist in terms of the US Overton window anything that negatively impacts workers wages while allowing companies to make more money doesnt sit right for me.

Also research suggests immigrants in the UK reduce wages of the lower end of the work force. Less so for skilled jobs. If proposals to tax companies more for using migrant Labour come in Im happy to concede this point as it will stop incentivising companies bring in cheap labour and undercut UK people.

On a side note I work in IT. Ive seen the stories from the US about how jobs have been outsourced to upcoming countries like India because its cheaper. We are in the process of signing a trade deal with India that India says must include free movement of people. 1) I find it weird how we left the EU because we wanted to avoid FOM but then are happy to sign up with India on the same or worse terms.

2) Id very much not like to lose my job because we can outsource it to India for a lot less.

Its a shitty situation no doubt. You could easily argue climate change is caused primarily by the west so we have a responsibility to recompense those most affected by it. I guess the answer depends on how practical it is to allow millions of people to come into the US at a time were seeing the inevitable death throes of neoliberalism. How much of a drop in our own standards of living wed be willing to take to do this. And ultimately whether it would even be feasible on a purely political level.

When climate change really hits home in a couple of decades the numbers were seeing now are going to look tiny in comparison. I dont think people are really prepared for the shit show thats going to ensue. Nor the difficult decisions that we are going to be faced with.

Ive never understood with regards to immigration, how is an immigrant joining the country different from a new American being born? Are people anti-immigration purely out of xenophobia?
