Ultimately I think that's the Legal Team at Nintendo's goal, to get a precedent to allow them to go after all emulators. The only reason emulators can still exist is because of "technicality's", basically a grey area in the copyright laws.Nintendo may not want to admit that there are games that they will refuse to ever re-release.
