No one is going to the Supreme Court with just a "this is the right thing to do" kind of argument. I mean, that's the heart of it, but it's obviously supported by case law and interpretation.

This is of course a rather extreme example but everyone involved in the holocaust was acting in an entirely legal fashion within Germany and it's occupied areas but I don't think you would be arguing against punishing them or that it was ok because it was legal.
Forcing the homeless to go without blankets in some areas in certain times of the year is just as much a death sentence as shooting them in the face. Thus the legality of it is irrelevant as to how I'm going view it.
So I'm going to make a further appeal to emotion here and say this as politely as I'm willing. Shut the fuck up.
