I've heard this as well - that the show is basically Scarface crossed with The Sopranos, and the main character being called The Penguin (and some of the other character names) is about the only real tie to Batman at all. Like you could essentially make the same show set in New York and without using DC comic names and it would be exactly the same.
But the thing is, that's basically what the Joaquin Phoenix Joker movie was, and people seemed to like that one. So "Batman without Batman" isn't necessarily a bad model to base shows around.
Ironically, it's more or less what Sony wants to do with all their "Spider-Man without Spider-Man" movies, they just seem to be way worse at it.
