TPC would have a case if PW stole Pokemon assets but I have yet to see official proof of that. And from what I understand, 'x monster from game 1 has some resemblance to y monster from game 2' alone isn't enough to make a case. If it did, it'd set a precedent that would allow other game series like Dragon Quest to sue Pokemon for making monsters that resemble their own.
